Well, since you point out the inconsistencies, I see where Bay's timelines are a bit... tangled.
I mostly presume both group names were taken by newer groups that may have no true heritage with the ancient holders of those titles, but a good excuse can be made that both modern Seekers and modern Constructicons are descendants of the ancient races that served the Primes.
At least, a friend was starting in a fic that was intended to have a fair bit about the relationship between Primes and Seekers in it, and one of the defining difference between true Seekers of Jetfire's ilk and upstarts claiming the name is that true Seekers bond with a Prime - a bond of service, not a romantic bond. They need to have a Prime they are beholden to, and who give them orders. Constructicons - true ones, may be similar, construction mechs bound in service to a Prime. Anything else is just a poseur contruction mech who is not a true 'Structie... but that leaves open the possibility that Devastator was made up of true Structies sent to Earth straight from the Nemesis... right where the Fallen's dorito sarcophagus was.
But whether or not Dev is true Structie or not doesn't mean he's not insane from losing some of his parts. Maybe the real movie Dev is more than just the roaring monster we saw - he was only like that because the rest of his parts are gone.
